Information on data transfer to the USA

Our website includes tools from companies based in the USA. When these tools are active, your personal data may be passed on to the US servers of the respective companies. We would like to point out that the USA is not a safe third country within the meaning of EU data protection law. US companies are obligated to surrender personal data to security authorities without you as the data subject being able to take legal action against this. Therefore, it cannot be ruled out that US authorities (e.g. intelligence services) process, evaluate and permanently store your data on US servers for monitoring purposes. We have no influence on these processing activities.

Withdrawal of your consent to the processing of your data

Many data processing operations are only possible with your express consent. You may withdraw your consent at any time. The legality of the data processing performed prior to the withdrawal remains unaffected by the withdrawal.

Right to object to the collection of data in special cases and to direct advertising (Art. 21 GDPR)

IF THE DATA IS PROCESSED ON THE BASIS OF ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS ARISING FROM YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION DECLARATION. IF YOU LODGE YOUR OBJECTION, WE WILL NO LONGER PROCESS YOUR RELEVANT PERSONAL UNLESS WE CAN PROVE COMPELLING LEGITIMATE REASONS FOR THE PROCESSING WHICH OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOM, OR THE PROCESSING SERVES THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION ON THE BASIS OF ART. 21 PARA. 1 GDPR).

WHERE PERSONAL DATA IS PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSES OF SUCH ADVERTISING, INCLUDING PROFILING TO THE EXTENT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION ACCORDING TO ART. 21 PARA. 2 GDPR).

Right to file complaints with the regulatory authorities

In the event of infringements of the GDPR, the data subjects shall have the right to appeal to a supervisory authority, particularly in the member state of their habitual residence, workplace or place of presumed infringement. The right of appeal shall be without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machinereadable format. If you request the direct transfer of data to another data controller, this shall only take place to the extent that is technically feasible.

SSL or TLS encryption

This website uses SSL or TLS encryption for security reasons and for the protection of the transmission of confidential content, such as the enquiries you send to us as the website operator. You can recognise an encrypted connection in your browser's address line when it changes from "http://" to "https://" and the lock icon is displayed in your browser's address bar.

If SSL or TLS encryption is activated, the data you transfer to us cannot be read by third parties.

Disclosure, deletion, and correction

As permitted by law, you have the right to be provided with information free of charge at any time about your personal data that is stored as well as its origin, the recipient and the purpose for which it has been processed. You also have the right to have this data corrected or deleted. If you have any further questions on the subject of personal data, please do not hesitate to contact us at any time.

Right to restrict processing

You have the right to request that the processing of your personal data be restricted. Feel free to reach out to us about this at any time. The right to restrict processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored with us, we usually need time to verify this. During the period of verification, you have the right to demand that the processing of your personal data be restricted.
  • If the processing of your personal data has taken/is taking place unlawfully, you can demand the restriction of data processing instead of data deletion.
  • If we no longer require your personal data but you do to exercise, defend or assert legal claims, you have the right to request that the processing of your personal data be restricted instead of data being deleted.
  • If you have lodged an objection pursuant to Art. 21 para 1 GDPR, your, as well as our interests, must be weighed. As long as it is not yet clear whose interests predominate, you have the right to demand that the processing of your personal data be restricted.

Where the processing of your personal data has been restricted, such data, apart from being stored, may be processed only with your consent, or for the purpose of asserting, exercising or defending rights or protecting the rights of another natural or legal person, or on the grounds of an important public interest of the European Union or a member state.

The website owner has a legitimate interest in storing cookies for the correct technical and optimised delivery of its services. Furthermore, you can configure your browser to inform you about the use of cookies so that you can decide to accept or reject each cookie. Alternatively, your browser can automatically accept cookies under certain conditions or can always reject them, and you can also tell it to automatically delete cookies when closing your browser. 7.1 Handling of applicant data

We offer you the opportunity to apply for positions with us (e.g. by email, post or via the online application form). In the following, we will inform you as to the scope, purpose and use of your personal data collected during the application process. We ensure that the collection, processing and use of your data are carried out in accordance with applicable data protection law and all other legal provisions and that your data is treated with strict confidentiality.

Scope and purpose of data collection

If you send us an application, we will process your related personal data (contact and communication data, application documents) insofar as this is necessary to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG-neu (Federal Data Protection Act New) under  German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general contract initiation).

If your job application should result in your recruitment, the data you have submitted will be archived on the grounds of Section 26 BDSG-neu and Art. 6 Sect. 1 lit. b GDPR for the purpose of implementing the employment relationship in our data processing system.

Data storage period

If there is no employment relationship, you will receive your documents back. We reserve the right to save a copy of your documents for 3 months in order to be able to clarify legal claims (Art. 6 para. 1 lit. f GDPR). The documents are then safely destroyed.

Admission to the applicant pool

If we do not make you a job offer, you may be able to join our applicant pool. In case of admission, all documents and information from the application will be transferred to the applicant pool in order to contact you in case of suitable vacancies.

The inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6 para. 1 lit. a GDPR). Giving your consent is voluntary and has no relation to the current application process. You can withdraw your consent at any time. In this case, the data from the applicant pool will be irrevocably deleted, provided there are no legal reasons for storage.

The data from the applicant pool will be irrevocably deleted no later than two years after consent has been granted.

We will retain your personal data until its deletion is requested, your consent for storage is withdrawn, or the purpose for its storage is no longer applicable (e.g. after the handling of your enquiry has been completed). Any mandatory statutory provisions—especially those regarding mandatory data retention periods under tax and commercial law—remain unaffected by this provision.
